Please read these Terms and Conditions ("Terms") carefully before using fWOWers.com (the "Site"), operated by Existential Garnish, Inc. ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
fWOWers.com is a public, self-directed listing and community platform for flower shops, florists and related floral businesses. The Company does not own, operate, employ, supervise, endorse or control any of the flower shops, florists or other businesses listed on the Site ("Listed Businesses").
The Site functions solely as a neutral, third-party directory and community platform. Listings are submitted by the businesses themselves or by third parties. The Company does not investigate, verify (beyond stated Google rating thresholds), warrant or guarantee the accuracy of any listing, the quality of any products or services offered by a Listed Business, the conduct or professionalism of any Listed Business or its employees, or any representation made by a Listed Business.
Your interactions and transactions with any Listed Business are solely between you and that business. Any dispute, complaint, dissatisfaction, harm, loss or claim arising from your engagement with a Listed Business — including but not limited to poor service, damaged goods, unprofessional conduct, failure to deliver, billing disputes or any other issue — is a matter between you and that business. The Company is not a party to any such dispute and bears no responsibility or liability for its outcome.
The fWOWer Shop! badge and any other designation on the Site reflects only that a business has met certain self-reported criteria (a minimum Google rating and annual listing fee) at the time of approval. It is not a guarantee of ongoing quality, conduct or customer satisfaction. The Company makes no representation that any Listed Business will meet your expectations or perform as described.
User-submitted ratings, votes, photos and comments on the Site reflect the opinions of individual users and do not constitute endorsements by the Company. We do not verify the accuracy of user-submitted content.
To the fullest extent permitted by applicable law, the Company, its officers, directors, employees, agents and affiliates shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from:
The Company's total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount, if any, paid by you to the Company in the twelve months preceding the claim.
By using the Site, you agree that you will not:
The Company reserves the right to remove any listing, photo, submission or user content at any time for any reason, including violation of these Terms, without prior notice and without liability.
By submitting a photo or other content to the Site, you represent that you own or have the right to submit the content, and you grant Existential Garnish, Inc. a non-exclusive, royalty-free, worldwide, perpetual license to display, reproduce and distribute the submitted content in connection with the operation and promotion of the Site. You retain ownership of your content. The Company does not claim ownership of submitted photos.
Free listings are offered at the Company's discretion and may be removed at any time. Premium fWOWer Shop! listings are subject to an annual fee. Fees are non-refundable except as required by applicable law. The Company reserves the right to change listing criteria, pricing or benefits at any time upon reasonable notice. Continued listing following notice of a change constitutes acceptance of the updated terms.
The fWOWers! name, logo, taglines, badges and all Site content created by the Company are the intellectual property of Existential Garnish, Inc. and may not be used without written permission. "Wanna WOW? We Can Arrange That.™" and "fWOWers!™" are trademarks of Existential Garnish, Inc.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. The Company does not warrant that the Site will be uninterrupted, error-free or free of viruses or other harmful components.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
